Most people in New York are unaware that the state is still one in which grounds are required to be divorced. Simply, having a "dead" marriage or being incompatible in insufficient for divorce. Grounds trials are difficult and require a good trial attorney whether you are prosecuting or defending. The reason for not desiring a divorce are many and not for right now but the grounds are listed in New York Domestic Relations Law Section 170.
I just got a complaint for divorce dismissed for a client who did not want the divorce for many reasons. I was able to prove the faults and defects in the complaint and show that the husband/wife really had no valid reason under New York State law for a divorce. What a great outcome and a happy client. It took time and we had to be aggressive in our case but the result ended in our favor.
