Child Support Attorney in Long Island
Do you need assistance with child support issues?
Normally most parents have the best interests of the children at heart, but when it comes to divorce, sometimes this goes by the wayside. As an experienced Long Island divorce attorney firm, it is our duty to keep an exterior view of this emotionally charged area and attempt to work out what is in the best interests of the children with your cooperation. Whether you are able to work out an amicable solution with your partner or not, the matrimonial system will ensure that this is done so as to protect the children’s well-being.
New York has an established formula known as the “Child Support Standards Act” that sets the rate of child support for the non-custodial parent to pay to the parent who has custody. This formula is calculated through a formula taking into account the income of both parents, with some allowed deductions. The support amount is calculated based on a percentage of the first $80,000 in combined income.
The percentages are:
- 1 Child 17%
- 2 Children 25%
- 3 Children 29%
- 4 Children 31%
- 5 or More Children 35%
Amounts above $80,000, are calculated at the court’s discretion. Parents may be allowed to agree on their own support figure, either higher or lower amounts than what is established by the Child Support Standards Act, under certain circumstances. We recommend you contact our office at Jonathan E. Kroll & Associates, PLLC to assist you in this regard. Our caring and attentive attorney will be happy to help you obtain an agreed child support figure for your family.
